Terms of Service

You must be at least 18 years of age to create an account or use the Services. By agreeing to these Terms, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement in your jurisdiction.

If you are accessing the Services on behalf of a company, record label, management entity, or other organization, you represent that you have the authority to bind that entity to these Terms, and references to "you" throughout these Terms include that entity.

To access most features of the Services, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are solely responsible for maintaining the security of your account credentials. Do not share your password with anyone. You are responsible for all activity that occurs under your account, whether or not you authorized it. If you suspect unauthorized access, contact us immediately at support@fansplug.com.

We reserve the right to suspend or terminate accounts that we determine, in our sole discretion, to be involved in unauthorized activity, fraud, or violations of these Terms.

Subscription Plans

Fans Plug offers subscription plans that provide access to platform features including Smartlinks, bio link pages, analytics, and discounted campaign rates. Subscription fees are billed on a recurring basis (monthly or annually) as specified at checkout.

Subscribers in good standing receive reduced pricing on campaign spend as part of their plan benefits. Campaign spend is billed separately from subscription fees.

Campaign Spend

Campaign budgets are charged separately from subscription fees. For managed YouTube campaigns, the full campaign budget is due before the campaign is launched. Self-serve campaigns are funded according to the platform's current billing flow.

Billing & Payment

All fees are charged in U.S. dollars and processed securely through our payment processor. By providing a payment method, you authorize us to charge all applicable fees to that method. You are responsible for all taxes and charges associated with your purchases.

We reserve the right to modify pricing at any time. Existing subscribers will be notified of price changes before they take effect. Continued use of the Services after a price change constitutes acceptance of the new pricing.

Subscription Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to subscription features until that date. Cancellation does not entitle you to a refund of any subscription fees already paid.

Managed YouTube Campaigns

When you purchase a managed YouTube ad campaign, Fans Plug will set up, launch, and optimize the campaign on your behalf using the budget you provide. You are responsible for ensuring that all creative assets (audio, video, images, links) you submit are original, properly licensed, and comply with YouTube's advertising policies and all applicable laws.

Fans Plug will make commercially reasonable efforts to optimize campaign performance, but we do not guarantee specific results including view counts, engagement rates, follower growth, or streaming increases. Digital advertising performance depends on many factors outside our control, including platform algorithm changes, audience behavior, and content quality.

Self-Serve Campaigns (Facebook & Spotify)

Self-serve campaigns are managed entirely by you through the Fans Plug platform. You are solely responsible for the content, targeting, compliance, and outcomes of any self-serve campaign. Fans Plug acts as a facilitator and is not responsible for campaign results or platform policy violations arising from your campaigns.

Creative Assets & Content Compliance

You represent and warrant that all content you submit for campaigns is free of third-party claims, does not infringe any intellectual property rights, and complies with the advertising policies of YouTube, Meta, and Spotify. Fans Plug reserves the right to reject or remove any content that we determine, in our sole discretion, to be in violation of platform policies or these Terms.

ALL CAMPAIGN PURCHASES ARE FINAL AND NON-REFUNDABLE. Once a campaign has been paid for and submitted, no refunds will be issued — regardless of campaign performance, platform changes, or early cancellation of the campaign by you.

This applies to all campaign types: managed YouTube campaigns, self-serve Facebook campaigns, and self-serve Spotify campaigns. Campaign budgets submitted to advertising platforms cannot be recovered once the campaign has been activated.

If you experience a technical error on our platform that prevents your campaign from launching, contact us at support@fansplug.com within 48 hours of the issue. We will investigate and, if the error is confirmed to be on our end, work toward a resolution which may include campaign credit at our discretion.

Subscription fees are non-refundable upon cancellation. Access continues through the end of the paid billing period.

We reserve the right to issue refunds or credits on a case-by-case basis solely at our discretion. Issuing a refund or credit in one instance does not obligate us to do so in any future instance.

"User Content" means any content you upload, submit, or transmit through the Services — including music files, artwork, videos, links, bio page content, and campaign materials.

You retain all ownership rights in your User Content. By submitting User Content to Fans Plug, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, reproduce, and distribute your User Content solely as necessary to provide and improve the Services. This license ends when you delete your content or close your account, except where content has already been used in active campaigns or features.

You represent and warrant that you own or have obtained all rights, licenses, and permissions necessary to submit and use your User Content on the Services, and that doing so does not violate any third-party rights or applicable law.

We are not obligated to store or back up your User Content. You are responsible for maintaining your own copies.

You agree not to use the Services to:

• Violate any applicable local, state, federal, or international law or regulation
• Infringe the intellectual property rights, privacy rights, or other rights of any third party
• Submit false, misleading, or fraudulent information including fake streaming data, bot traffic, or fabricated engagement
• Use bots, scripts, or automated means to interact with the platform without our written consent
• Attempt to access systems, accounts, or data you are not authorized to access
• Reverse engineer, decompile, or attempt to extract source code from any part of the Services
• Interfere with or disrupt the integrity or performance of the Services or any connected infrastructure
• Upload content that contains malware, viruses, or any other harmful code
• Harass, threaten, or intimidate other users or Fans Plug staff
• Use the platform to promote or distribute content that is unlawful, defamatory, obscene, or otherwise objectionable
• Circumvent or attempt to circumvent any billing, access, or fraud-prevention mechanisms
• Resell or commercially exploit any part of the Services without our prior written authorization

We reserve the right to investigate and take appropriate legal and technical action against any user who violates this section, including account termination without refund.

FANS PLUG HAS A ZERO-TOLERANCE POLICY FOR FRAUD. This includes but is not limited to: unauthorized chargebacks, payment fraud, submitting stolen payment credentials, purchasing campaigns with the intent to dispute or reverse payment, and any attempt to manipulate, deceive, or defraud the platform or its team.

If we determine that your account has been used for fraudulent activity, we will take all of the following actions without exception:

• Immediate and permanent account termination — with no refund of any funds on account.
• Recovery of damages — we will pursue recovery of all amounts owed, including chargeback fees, platform losses, and any costs incurred in connection with the fraud, through all available legal means.
• Reporting to authorities — fraudulent activity will be reported to applicable law enforcement agencies and financial institutions.
• Industry blacklisting — the account, associated identifiers, and relevant details may be shared with industry partners and blacklisted from accessing the platform or any affiliated services permanently.
• Legal action — we reserve the right to pursue civil and criminal remedies to the fullest extent of the law.

Chargebacks initiated without first contacting us to resolve a dispute will be treated as fraudulent and subject to all of the above. Contact support@fansplug.com before initiating any payment dispute.

The Fans Plug name, logo, platform design, and all underlying technology are the proprietary property of Every Summer Entertainment and its licensors. The "Fans Plug" trademark and associated intellectual property are exclusively licensed to Every Summer Entertainment.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your own lawful, personal or business purposes. This license does not include the right to:

• Reproduce, modify, or create derivative works of any part of the Services or platform content
• Publicly display or distribute any proprietary Fans Plug content
• Use any Fans Plug trademark, logo, or brand element without prior written permission
• Use data scraping, crawlers, or extraction tools to harvest content or data from the platform

Any feedback, suggestions, or ideas you submit about the Services may be used by Fans Plug freely and without any obligation to compensate you.

The Services integrate with and facilitate advertising on third-party platforms including YouTube, Meta (Facebook and Instagram), and Spotify. Your use of these platforms through Fans Plug is also subject to each platform's own terms of service and policies:

• By connecting YouTube, you agree to YouTube's Terms of Service and Google's Privacy Policy.
• By connecting Meta, you agree to Meta's Terms of Service and Data Policy.
• By connecting Spotify, you agree to Spotify's Terms and Conditions and Privacy Policy.

Fans Plug is not responsible for the actions, policies, or availability of any third-party platform. We do not control and are not liable for any changes these platforms make that may affect your campaigns or account.

Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the data practices described in that Policy.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FANS PLUG DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CAMPAIGN WILL ACHIEVE ANY PARTICULAR RESULT IN TERMS OF VIEWS, STREAMS, FOLLOWERS, OR OTHER METRICS. USE OF THE SERVICES IS AT YOUR SOLE RISK.

We do not endorse, control, or take responsibility for any third-party content, platforms, or services linked to or accessed through the Services.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FANS PLUG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event will Fans Plug's total aggregate liability to you for any claims arising out of or related to these Terms or the Services exceed the greater of (a) the total amount you paid to Fans Plug in the 90 days preceding the claim, or (b) $100 USD.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Fans Plug, Every Summer Entertainment, and their respective officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of or access to the Services
• Your User Content or campaign materials
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Any fraudulent, deceptive, or illegal activity conducted through your account

Please read this section carefully. It requires you to resolve most disputes through binding arbitration rather than court, and waives your right to participate in a class action.

Informal Resolution First

Before initiating any formal dispute, you agree to contact us at support@fansplug.com and give us 30 days to resolve the issue informally. Most problems get resolved at this stage.

Binding Arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, which are available at jamsadr.com. Arbitration will be conducted in Sheridan County, Wyoming, or remotely by mutual agreement.

The Federal Arbitration Act governs the enforceability of this section. The arbitrator has exclusive authority to resolve disputes over the interpretation, applicability, or enforceability of these Terms.

Class Action Waiver

You and Fans Plug agree that all claims must be brought in an individual capacity, not as a plaintiff or class member in any class action, consolidated action, or representative proceeding. The arbitrator may not consolidate more than one person's claims.

Exceptions

Either party may bring an individual action in small claims court for disputes within that court's jurisdiction. Either party may seek emergency injunctive relief in court to prevent irreparable harm pending arbitration, including in connection with alleged intellectual property infringement or unauthorized access.

Opt-Out

You may opt out of binding arbitration within 30 days of first accepting these Terms by emailing support@fansplug.com with "Arbitration Opt-Out" in the subject line and your full name and account email. Opting out does not affect any other Terms.

Time Limit

Any claim arising from these Terms or the Services must be filed within one (1) year of the date the claim arose. Claims not filed within this period are permanently barred.

THESE TERMS ARE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF WYOMING, WITHOUT REGARD TO CONFLICT OF LAW PRINCIPLES. ANY DISPUTE NOT SUBJECT TO ARBITRATION WILL BE RESOLVED EXCLUSIVELY IN THE STATE OR FEDERAL COURTS LOCATED IN SHERIDAN COUNTY, WYOMING. YOU CONSENT TO PERSONAL JURISDICTION IN THOSE COURTS.

Changes to These Terms

We may update these Terms at any time. When we do, we will update the effective date at the top of this page and notify you by email or through the platform. Continued use of the Services after the updated Terms are posted constitutes your acceptance. If you do not agree to the updated Terms, stop using the Services.

Termination by You

You may close your account at any time through your account settings or by contacting support@fansplug.com. Termination does not entitle you to a refund of any paid fees.

Termination by Fans Plug

We reserve the right to suspend or permanently terminate your account at any time, with or without notice, for any violation of these Terms — including but not limited to fraud, payment disputes, prohibited conduct, or abuse of the platform. Upon termination, your right to access the Services ceases immediately. Sections of these Terms that by their nature should survive termination will do so.

• Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Fans Plug with respect to the Services and supersede all prior agreements.
• Severability. If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.
• Waiver. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
• Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights freely.
• Electronic Communications. By creating an account, you consent to receive electronic communications from us including account notifications, transactional messages, and updates about the Services.
• No Third-Party Beneficiaries. These Terms do not confer any rights on any third party except as expressly stated.
